海洋散骨について

　海洋散骨とは、その名の通り海でご遺骨を散骨することを指します。散骨は海以外にも樹木葬や宇宙葬といった自然散骨が存在します。弊社では、鎌倉市より湘南エリア、東京湾での海洋散骨を施行いたします。

では、そもそも海洋散骨を行っていいかに触れたいと思います。

結論から言うと行って良いです。

日本では、今まで「墓地・埋葬等に関する法律」により散骨は、遺体遺棄に当たると考えられてきました。しかし、１９９１年に葬送の自由をすすめる会により施行された相模灘での海洋散骨を機に、以下の内容が国から示されました。

法務省は、葬送の一つとして節度をもって行われる限り、遺骨遺棄罪には当たらない

厚生労働省は、墓地・埋葬等に関する法律はもともと土葬を問題にしていて、遺灰を海や山にまくといった葬法は想定しておらず、対象外である。だからこの法律は自然葬を禁ずる規定ではない

現在では、令和２年度厚生労働科学特別研究事業「墓地埋葬をめぐる現状と課題の調査研究」において、取りまとめられたガイドラインを根拠とし、海洋散骨を施行しているのが現状です。また、日本海洋散骨協会が策定しているガイドラインを参考にしている事業所も多く存在します。

古代より執り行われていた海洋散骨は、グレーゾーンとなった近代日本に置いて、先人たちの行動により取り戻された葬送の選択肢なのです。

In addition, there are many businesses that refer to the guidelines formulated by the Japan Sea Scattering Association.
